Amends Florida law to set the maximum number of students participating in the Family Empowerment Scholarship Program at 26,500 students annually beginning in the 2022-2023 school year for the 2023-2024 school year.

Beginning in the 2023-2024 school year, the maximum number of participating students shall annually increase by 3.0 percent of the state's total exceptional student education full-time equivalent student membership, excluding gifted students.

Excludes certain students from the maximum participation cap, including those receiving Voluntary Prekindergarten services with an IEP, dependent children of law enforcement/military, foster and adopted children, and students who previously attended Florida public schools.

Scholarship amounts are calculated based on student service levels (Level I-V) and correspond to the Florida Education Finance Program funding for the student's would-be grade level and school district, plus categorical program funds.

The act takes effect upon becoming law.
