SB 96 – "Self-Defense Restoration Act"

• Removes Florida's "Stand Your Ground" provisions by deleting language stating that persons using or threatening force have no duty to retreat before using non-deadly force in defense of themselves or others
• Prohibits the use of deadly force if the person knows they can avoid the necessity of using it by retreating with complete safety, effectively restoring a duty to retreat for deadly force situations
• Applies the same retreat requirement to the use or threatened use of deadly force in defense of property, replacing the existing Stand Your Ground protections in that context
• Repeals Section 776.032, F.S., which currently grants immunity from criminal prosecution and civil action for justifiable use or threatened use of force
• Sponsored by Senator Jones; would take effect immediately upon becoming law
