SB 394 — School Employees ("Stratton's Law")

• Risk protection orders (red flag orders) must now indicate whether the respondent is a district school board member or employed as instructional personnel
• Courts issuing risk protection orders against school board members or instructional personnel must require the petitioner to immediately notify the respondent's employer or entity of the order's issuance
• Instructional personnel must disclose all prior arrests, criminal convictions, guilty pleas, nolo contendere pleas, and any expunged criminal records to their employer, in addition to existing background screening requirements
• Persons found ineligible for employment or convicted of crimes involving moral turpitude may not serve in any position requiring direct contact with students
• Effective date is July 1, 2024
