SB 7068 – Pretrial Detention Hearings

• Amends section 907.041, Florida Statutes, to explicitly authorize courts to base pretrial detention orders solely on hearsay evidence
• Maintains existing protections that evidence obtained in violation of the U.S. Constitution or the Florida Constitution remains inadmissible at detention hearings
• Preserves the defendant's right to be represented by counsel, to present witnesses and evidence, and to cross-examine witnesses, but reorganizes these rights into a separate paragraph
• Reaffirms that a defendant's testimony at a pretrial detention hearing cannot be used to prove guilt in other judicial proceedings, though it may be used in perjury or impeachment actions
• Takes effect immediately upon becoming law
