HB 1139 — Termination of Pregnancies

• Replaces Florida's current 6-week gestational age ban on abortion with a fetal viability standard, prohibiting physicians from knowingly performing a termination after determining the fetus is sustainable outside the womb through standard medical measures.
• Retains the exception allowing termination when two physicians certify in writing that it is necessary to save the pregnant woman's life or avert serious risk of substantial and irreversible physical impairment of a major bodily function (excluding psychological conditions).
• Retains the single-physician emergency exception when another physician is unavailable for consultation and there is a medical necessity to save the woman's life or avert imminent substantial and irreversible physical impairment.
• Removes the third-trimester restriction on the fatal fetal abnormality exception, allowing termination for a certified fatal fetal abnormality at any point before viability rather than only before the third trimester.
• Eliminates the existing exception permitting abortion up to 15 weeks for pregnancies resulting from rape, incest, or human trafficking, along with all associated documentation and reporting requirements.
• Effective date: July 1, 2025.
