SB 604 – Residential Swimming Pool Requirements

• Swimming pools on residential property transferred or sold on or after October 1, 2025, must be equipped with at least one pool safety feature (e.g., safety cover, exit alarms, self-closing/self-latching doors, or pool alarm) regardless of when the pool was built
• Pools on residential property sold or transferred on or after October 1, 2025, must also meet all pool barrier requirements, including a barrier at least 4 feet high with no gaps or climbable components, placed around the pool's perimeter
• Title companies, inspectors, or mortgage underwriters associated with the residential property transaction are required to report violations of these requirements to local law enforcement
• Failure to equip a residential pool with the required safety features is a second-degree misdemeanor, but penalties are waived if the owner installs a compliant safety feature and attends a drowning prevention education program within 45 days of citation
• The act takes effect July 1, 2025
