SB 908 – Cyberintimidation by Publication

• Increases the criminal penalty for electronically publishing another person's personal identification information with intent to incite violence, commit a crime, or threaten or harass the person from a first-degree misdemeanor to a third-degree felony
• Removes the existing requirement that the victim be placed in "reasonable fear of bodily harm" for the offense of threatening or harassing through publication of personal information
• Creates a new civil cause of action allowing victims to sue perpetrators for injunctive relief, monetary damages, reasonable attorney fees and costs, and any other appropriate relief in law or equity
• Requires aggrieved persons to meet a clear and convincing evidence standard to prevail in a civil action
• Sponsored by Senator Polsky, with an effective date of October 1, 2025
