SB 992 – Products Liability Actions Under the Florida Pesticide Law

• Creates section 487.082, Florida Statutes, prohibiting products liability actions (including failure to warn) against pesticide distributors, dealers, applicators, registrants, or agricultural employers unless specific conditions are met
• Liability may only proceed if the defendant exercised substantial control over design, testing, manufacture, or labeling; altered or modified the product in a way that substantially caused the harm; handled or applied the product inconsistently with its label; or the manufacturer is not subject to Florida jurisdiction
• Bars failure-to-warn products liability claims against pesticide manufacturers if the product is registered under the federal FIFRA program and the label is approved by the EPA, consistent with the most recent FIFRA human health assessment, or consistent with the EPA's carcinogenicity classification
• Establishes that an EPA-approved FIFRA-compliant label satisfies any state requirement for health or safety warning labels under general law
• Takes effect July 1, 2025, and was introduced by Senator Collins
