Vaccine manufacturers become liable to individuals if they advertise a vaccine in Florida and that advertised vaccine causes harm or injury to the individual

"Advertise" is defined broadly to include TV, radio, print, internet, digital media, product placement, and paid influencer promotions purchased by the manufacturer

Exemptions from the advertising definition include doctor-patient discussions, written materials providers give patients, and posters or promotional items displayed in healthcare facilities

Individuals may file a lawsuit within 3 years following the accrual of the cause of action, notwithstanding any other law

Prevailing claimants are entitled to actual damages, court costs, and reasonable attorney fees; effective date is October 1, 2026
