Requires the Division of Alcoholic Beverages and Tobacco to conduct regular inspections of retail nicotine dealers who advertise, promote, or display nicotine dispensing devices that lack FDA marketing authorization under 21 U.S.C. s. 387j

Establishes escalating penalties for violations involving unauthorized nicotine devices: first offense $500-$1,000 fine with 15-day corrective action; second offense $1,000-$2,500 fine plus up to 3-day permit suspension; third offense $2,500-$5,000 fine plus up to 30-day suspension; fourth offense $5,000+ fine plus up to 90-day suspension; fifth offense results in permit revocation

Prohibits dealers that allow individuals under 21 on premises from advertising, promoting, or displaying unauthorized nicotine devices either inside or outside the licensed location in areas visible to minors

Allows dealers that prohibit individuals under 21 from their premises to advertise, promote, and display FDA-authorized nicotine devices in areas visible inside or outside the licensed location

Requires the division to adopt compliance audit and enforcement rules for unauthorized nicotine devices and to include violation statistics in its annual report to the Legislature and Governor by December 31
