Local governments are prohibited from enacting drinking straw or stirrer regulations unless they permit products that are renewable, home compostable certified, industrial compostable certified, or marine biodegradable

Existing local ordinances restricting straws must be amended by January 1, 2027 to allow these environmentally-certified alternatives

"Renewable" products must be certified under the USDA BioPreferred Program with at least 80% biobased content or TUV Austria OK biobased program with a 4-star rating

Exemptions apply to straws in prepackaged drinks sold commercially and straws used in hospitals, medical care facilities, and senior care facilities

Local governments are not required to adopt any straw regulations; the law only sets standards if they choose to regulate
