Prohibits local governments and the Department of Environmental Protection from issuing construction permits for new ash-producing incinerators or waste-to-energy facilities located within 1 mile of congressionally authorized impoundment areas with at least 100 acres of interior storage used for water conservation, wetland protection, endangered species habitat, flood mitigation, or groundwater recharge

Exempts from the prohibition: canals, facilities existing as of July 1, 2026 (including modifications), and parcels in counties with populations under 1.7 million per the 2020 census

Amends sections 403.706 and 403.707, Florida Statutes, applying the siting restriction to both local government permits and state Department of Environmental Protection permits

Takes effect July 1, 2026
