Malt beverage manufacturers producing less than 31,000 gallons per calendar year may sell and deliver directly to vendors, bypassing the traditional distributor requirement

Small manufacturers (under 31,000 gallons in the 12 months before a franchise agreement) may terminate distributor franchise agreements without paying compensation if they provide 24 months written notice and terminate within 36-38 months of the agreement's effective date

The Division of Alcoholic Beverages and Tobacco may certify a manufacturer's yearly production amount upon request, with such certification serving as prima facie evidence; manufacturers limited to one certification request per 12-month period

Division determination that a manufacturer produces under 31,000 gallons remains effective for 3 years

Applies to franchise agreements entered into on or after July 1, 2026, and these provisions cannot be waived by contract
