Prohibits operating a vehicle while using a wireless communications device in a handheld manner when committing a careless driving violation, with an additional $60 fine and 1 point assessed against the driver's license

First-time offenders may complete a wireless communications device driving safety program approved by the department to have the additional fine and point waived

Exemptions include stationary vehicles, emergency responders performing official duties, reporting emergencies to law enforcement, using hands-free or voice-operated devices, receiving navigation/safety messages, and operating autonomous vehicles in autonomous mode

Law enforcement must inform stopped drivers of their right to decline a device search and cannot access, confiscate, or coerce consent to search a wireless device without a warrant

The $60 additional fine is deposited into the Emergency Medical Services Trust Fund of the Department of Health; effective date is July 1, 2026
