Officer Cochran arrested Jackson for disobeying a law enforcement officer after Jackson drove to a second pay phone when the first was non-operational; the officer then fired through the windshield, striking the unarmed Jackson in the neck

A Polk County jury awarded Jackson $412,500 in damages, but sovereign immunity limits under s. 768.28, Florida Statutes, restricted collection to $100,000, requiring a claim bill for the remaining amount

Attorney fees for this claim are capped at 25 percent of the amount awarded under the act
