Requires residential swimming pools on properties transferred or sold on or after October 1, 2026 to be equipped with at least one approved safety feature, regardless of when the pool was built

Mandates sellers disclose to prospective buyers whether the pool meets safety feature requirements and pool barrier requirements before the transfer or sale

Approved safety features include: pool barriers meeting statutory requirements, approved safety pool covers, exit alarms (minimum 85 dB at 10 feet) on doors/windows with pool access, self-closing/self-latching doors with releases at least 54 inches high, or ASTM-certified pool alarms

Pool barriers must be at least 4 feet high, have no climbable gaps or protrusions, be placed around the pool perimeter separate from yard fencing, and be positioned away from the water's edge

Failure to equip a pool with required safety features is a second-degree misdemeanor, though penalties are waived if compliance is achieved within 45 days and a drowning prevention education program is attended
