Expands eligibility for grandparents to petition for court-ordered visitation with a minor grandchild to include situations where the child's parents are divorced, in addition to existing circumstances where one or both parents are deceased, missing, or in a persistent vegetative state

Removes the previous requirement that grandparents demonstrate "parental unfitness or significant harm to the child" to proceed with a visitation petition; instead requires showing that parents are divorced or one/both parents are deceased, missing, or in a persistent vegetative state

Eliminates the presumption in favor of grandparent visitation when one parent was criminally or civilly liable for causing the death of the other parent

Requires the court to consider whether the grandparent established a relationship with the child before the parents divorced, in addition to before a parent's death, persistent vegetative state, or disappearance

Effective date of July 1, 2026
