GA HB1401

Creates the City of College Park Water and Sewer Authority as a public body corporate and political subdivision of Georgia with perpetual existence, responsible for acquiring, constructing, operating, and maintaining water supply, wastewater, and storm-water management facilities.

The authority consists of five members serving ex-officio: the mayor and city council members of College Park, with the mayor as chairperson; members receive no compensation but are reimbursed for actual expenses, and three members constitute a quorum.

Authorizes the authority to issue tax-exempt negotiable revenue bonds under Georgia's Revenue Bond Law to finance projects, with bonds payable solely from project revenues and not constituting a debt or pledge of the credit of the State of Georgia or the City of College Park.

Grants the authority broad powers including acquiring property by purchase or condemnation, entering contracts for up to 50 years with public and private entities, setting rates and collecting fees, employing staff, and accepting federal and state grants and loans.

The authority's properties and income are exempt from all state and local taxes, its property is not subject to levy and sale, and it has the same tort immunity as the City of College Park but has no power to impose taxes.
