GA HB1150

Legalizes the cultivation, processing, testing, sale, and possession of cannabis for adults 21 and older in Georgia, administered by the Georgia Department of Revenue through a tiered licensing system with annual fees ranging from $250 for home grower permits to $25,000 for large indoor cultivator licenses, plus a $5,000 nonrefundable application fee

Imposes a 15% wholesale tax on cannabis sold from cultivators to processors and a 15% wholesale tax on cannabis/cannabis products sold from processors to retailers, with counties and cities authorized to levy an additional license fee of up to 5% of gross revenue on cannabis businesses

Establishes a seed-to-consumer tracking system and limits retail licenses to no more than one per 2,300 persons per county (minimum two per county), with retail stores restricted to selling only cannabis, cannabis products, and cannabis accessories in child-proof, THC-labeled packaging

Removes marijuana from the state's excise tax on controlled substances, repeals the misdemeanor penalty for possession of one ounce or less, and makes conforming changes to criminal statutes so that licensed cannabis activities under the new chapter are exempt from prosecution

Prohibits smoking cannabis in public (misdemeanor), requires retail stores to display health warnings about pregnant women and underage purchasers, and removes marijuana possession jurisdiction from municipal, magistrate, and probate courts through conforming amendments across Titles 15, 16, 17, and 36
