Transfers governance of the Georgia ABLE Program from the separate Georgia ABLE Program Corporation board of directors to the board of directors of the Georgia Higher Education Savings Plan, dissolving the ABLE Corporation board upon the Act's effective date

Expands the Georgia Higher Education Savings Plan board by adding the commissioner of behavioral health and developmental disabilities and the commissioner of community health as members, and increases Governor-appointed directors from three to four, with at least one being a person with a disability, a family member of a person with a disability, or a disability advocate

Removes the Governor as automatic chairperson of the board; instead requires the board to elect a chairperson from its membership, with the state treasurer serving as vice chairperson and administrative officer

Ensures continuity by transferring all contracts, property, funds, liabilities, rules, and obligations of the former ABLE Program Corporation board to the Georgia Higher Education Savings Plan board, with no rights or duties impaired by the transfer

Removes the board's authority to impose a 10 percent penalty on earnings from withdrawals for nonqualified disability expenses or fraudulent participation agreements, and takes effect upon the Governor's approval
