GA HB1592

Creates the Long County Building and Public Facilities Authority as a body corporate and politic and instrumentality of the State of Georgia, authorized to acquire, construct, equip, maintain, and operate buildings and facilities for use by Long County and municipalities within the county for governmental, proprietary, and administrative functions.

Authority consists of 5 members appointed by the Long County Board of Commissioners, with no more than 2 being commissioners; non-commissioner members serve 3-year terms, members receive no compensation but may be reimbursed for actual expenses, and 2 members constitute a quorum.

Authorizes the authority to issue revenue bonds payable solely from its revenues, rents, and earnings—not constituting a debt or pledge of credit of the State of Georgia or Long County—and to enter into contracts, leases, and trust agreements to secure bond repayment.

Exempts the authority's property and income from taxation (excluding sales and use tax) and grants the authority the same tort immunity as Long County; authority property is not subject to levy and sale under legal process.

Upon dissolution and full payment of all bonded indebtedness, all authority property shall be conveyed to Long County; all legal actions involving the authority must be brought in the Superior Court of Long County.
