GA HB1112

Removes the Secretary of State as an ex officio nonvoting member of the State Election Board, including eliminating the exemption that previously shielded the Secretary of State from the board vacancy rule when qualifying as a candidate for public office

Transfers the board's administrative attachment from the Secretary of State's office to the State Accounting Office, effective July 1, 2024, and strikes language stating the board is not under the Secretary of State's jurisdiction (as that relationship is fully severed)

Grants the State Election Board explicit authority to investigate the elections division of the Secretary of State's office, in addition to its existing authority over local election officials

Authorizes the board to hire its own investigators with experience and knowledge qualifications determined by the board, and empowers the board to issue letters of instruction (for technical violations due to excusable neglect without bad faith) or letters of reprimand (for violations due to inexcusable neglect, gross neglect, or bad faith) as alternatives to formal enforcement orders

Adds the Secretary of State and the chairpersons of legislative standing committees on election matters to the list of officials who must receive email notice when the board considers emergency rules or regulations
