GA HB1420

Creates a new felony offense under Georgia law for any non-regulated person to possess, purchase, deliver, sell, or possess with intent to sell or deliver a pill press, tableting machine, encapsulating machine, or other controlled substance counterfeiting materials when the person knows or has reasonable cause to believe they will be used to manufacture controlled or counterfeit substances.

Punishes violations with imprisonment of not less than 1 year and not more than 10 years.

Exempts "regulated persons" from the offense, defined as specific categories of persons or entities under Georgia's pharmacy law (Code Section 26-4-5), such as pharmacists, manufacturers, and other licensed professionals.

Defines key terms including "pill press" (mechanical device compressing powder into tablets using a die mold), "tableting machine" (equipment compacting powdered or granular material into solid tablets), and "encapsulating machine" (equipment filling shells or capsules with powdered or semisolid material).

Defines "controlled substance counterfeiting material" as punches, dies, plates, stones, or other items designed to reproduce trademarks, trade names, or identifying marks on drugs or their containers to render them counterfeit substances.
