Health insurers must pass along at least 80% of all prescription drug rebates received from manufacturers, pharmacies, or other third parties to enrollees at the point of sale, reducing enrollees' cost sharing amounts

Applies to state-regulated commercial health plans including state employee plans, public school teacher and employee plans, and the Regents Health Plan; excludes self-funded ERISA plans

Rebates include negotiated price concessions, base price concessions, price protection rebates, and performance-based concessions from manufacturers or pharmacies

Noncompliance may result in civil penalties and suspension or revocation of an insurer's license under Code Section 33-2-24

Effective January 1, 2026, applying to all policies issued, delivered, or renewed on or after that date
