GA HB1035

Prohibits foreclosure, tax sales, or forced sales of owner-occupied dwellings based on unpaid nontax service charges, including HOA/condo assessments, fines, water, sewer, stormwater, and solid waste fees

Reclassifies condominium and property owners' association assessments as unsecured personal debts collectible only through money judgments, not through liens enforceable against owner-occupied homes

Bars local governments from adding unpaid utility service charges to ad valorem tax rolls for purposes of tax execution or tax sale of owner-occupied dwellings

Preserves associations' rights to suspend common area amenities, levy late charges, and record delinquency notices, but voids any contractual provisions authorizing foreclosure for nontax charges

Creates civil remedies including up to $5,000 statutory damages per violation for property owners and up to $10,000 penalties per violation enforceable by the Attorney General; effective July 1, 2026
