Racing facilities in Georgia gain immunity from public and private nuisance lawsuits brought by property owners who purchased land or built after the facility was already operating

Protected area extends 5 miles around racing facilities in rural counties (population under 50,000) and 3 miles in other counties

Racing facilities operating for at least one year cannot be deemed a nuisance solely due to changed conditions in the surrounding area related to racing operations

Immunity does not apply if the racing facility makes material changes to its historic operations; also excludes ATV racing, recreational off-road riding, and unorganized vehicle use

Effective July 1, 2026, applying to all nuisance actions filed on or after that date
