Property owners' associations must send initial written notice via certified mail or statutory overnight delivery to lot owners identifying any outstanding fines or delinquent fees before collecting attorney's fees

Lot owners must be given 30 days from receipt of the notice to pay outstanding fines or delinquent fees

Associations must provide an itemized list of reasonable attorney's fees claimed before collecting such fees

Judges conducting bench trials must review attorney's fee claims for reasonableness and enter an order confirming reasonableness before an association can be awarded attorney's fees

Effective July 1, 2026, applying to all actions filed on or after that date
