Local school systems with a College and Career Ready Performance Index (CCRPI) average below 70 for the previous two school years are prohibited from providing virtual instruction to out-of-system students (students who reside in a different school district)

Out-of-system students cannot be counted toward a local school system's enrollment for purposes of qualifying for state equalization funds

Local school systems enrolling out-of-system students must compile complete lists of those students as of October 1 and March 1 each year

Virtual schools with more than 5% out-of-system student enrollment must spend 90% of state funds earned for those students on virtual instruction costs and return excess funds to the state treasury
