GA HB1301

Amends Georgia Code Section 10-1-393.14 governing consumer reports furnished for employment purposes, expanding the types of criminal history records that must be accurately reported

Requires consumer reporting agencies to accurately reflect the present legal status of arrests, indictments, convictions, record restrictions, vacated offenses, offenses discharged under Code Sections 16-13-2 or 42-8-60, and pardons as of the date the report is furnished

Prohibits consumer reporting agencies from reporting sealed criminal history record information if restricted and sealed by court order or as a matter of law

Maintains existing requirement that consumer reporting agencies either notify consumers when public record information is being reported or maintain strict procedures to ensure such information is complete and up to date

Consumer reporting agencies compliant with the federal Fair Credit Reporting Act as of March 11, 2015 are deemed compliant with this Code section
