Local school systems and public schools must adopt policies granting students up to 5 excused absences per school year for mental health days, defined as absences due to mental health or emotional well-being

Parents, guardians, or students 18+ (or emancipated minors) must notify the school of mental health day absences, but schools cannot require disclosure of specific mental health information to approve the absence

Public schools must notify parents and guardians of available mental health resources and services at the beginning of each school year or upon enrollment

The State Board of Education must develop a model policy for local school systems to implement these requirements

Effective July 1, 2026, applying to the 2026-2027 school year and beyond
