Local governments with zoning ordinances must require special use permits for the operation or development of immigration detention centers within their territorial boundaries

Special use permits are also required for any transfer of real property to the federal government for the purpose of operating a detention center

Immigration detention centers are defined as any facility in Georgia holding noncitizens pending immigration proceedings or removal, including private facilities contracted by the federal government

Amends Chapter 66 of Title 36 of the Official Code of Georgia Annotated, relating to zoning procedures for counties and municipal corporations

Effective date of July 1, 2026, applying to all zoning decisions occurring on or after that date
