Sheriff candidates must be certified peace officers not under revocation by the Georgia Peace Officer Standards and Training Council, or if uncertified (first responders, military veterans, or law enforcement officers), must complete certification within six months of taking office.

Prosecuting attorneys placing a peace officer on a Giglio list (officers disqualified from trial testimony due to credibility issues) must provide written notice to the officer's employer and POST Council, including the factual basis and information about reconsideration rights within 30 days.

The POST Council must review Giglio list placements and cannot suspend, revoke, or sanction an officer solely based on Giglio list inclusion; law enforcement agencies similarly cannot take adverse employment action based solely on list placement without an internal investigation or Council discipline.

Prosecuting attorneys receive civil immunity for Giglio list placements unless the affected officer demonstrates actual malice or intent to cause injury.

Records relating to Giglio lists are exempt from public disclosure under Georgia's open records law.
