Counties and municipal corporations may adopt local ordinances governing possession of one ounce or less of marijuana, allowing them to set their own enforcement policies and penalties

Maximum punishment under local ordinances cannot exceed a $1,000.00 fine, with no jail time permitted for violations prosecuted under these local rules

State law penalties for possession of one ounce or less remain a misdemeanor punishable by up to 12 months imprisonment, up to $1,000.00 fine, or up to 12 months public works—but local ordinances can supersede this

All fines and bond forfeitures from local marijuana possession prosecutions are retained by the county treasury rather than going to the state

Amends O.C.G.A. Code Sections 16-13-2 and 36-1-20 to authorize this local control framework
