Vacancies on the Mitchell County Board of Commissioners occurring during the first 21 months of a term require a special election held on the earliest available even-numbered year election date (presidential preference primary, general primary, or November general election)

The chief judge of the judicial circuit appoints a temporary replacement to serve until the special election winner is sworn in for early-term vacancies

Vacancies occurring during the last 27 months of a term are filled entirely by appointment from the chief judge of the judicial circuit, with no special election required

The appointed person serves the remainder of the unexpired term until a successor is duly elected and qualified

Amends the original 1873 Act establishing the Mitchell County Board of Commissioners, as previously amended in 2002
