Georgia Department of Education may employ retired teachers who are receiving benefits from the Teachers Retirement System of Georgia without suspending their retirement allowance

Retirees employed under this provision continue receiving full retirement benefits and any postretirement benefit adjustments they qualify for

Employment with the Department of Education does not count as creditable service and will not result in recalculation of retirement benefits

Exception: Retirees who work at schools operated by the Department of Education are excluded from this provision and remain subject to existing rules requiring benefit suspension

Effective date is July 1, 2026, contingent on concurrent funding as required by the Public Retirement Systems Standards Law; automatically repeals if funding is not provided
