GA SB12

Adds a statutory definition of "custodian" or "lawful custodian" as the agency with charge, custody, care, and control over public records, or a designated employee of that agency

Requires all public records requests to be made directly to a custodian rather than to private parties holding the records

Mandates custodians retrieve public records held by private persons or entities that perform services for government agencies or store records on behalf of agencies

Obligates private persons and entities to produce public records to custodians upon request, subject to statutory document retention guidelines or contractual retention periods, whichever is longer

Effective upon approval by the Governor or upon becoming law without such approval
