GA SB296

Creates new offense of "operation of a school bus while under the influence of alcohol or drugs" for licensed school bus drivers who drive a school bus while impaired, punishable by 1-5 years imprisonment and/or $1,000-$5,000 fine

Establishes separate offense of "endangering school bus occupants while under the influence" for impaired drivers who cause accidents resulting in damage to an occupied school bus, with same penalty range but mandatory minimum of 90 days imprisonment that cannot be suspended or probated

Both new offenses are charged separately from and cannot be merged with standard DUI charges for prosecution and sentencing purposes

Repeals existing Code Section 40-6-391.3 relating to school bus DUI penalties, replacing it with these new provisions

Makes conforming changes to clarify that bicycle riders are exempt from these school bus-related DUI penalties
