Exempts cancer-focused health care facilities, services, and equipment from Georgia's certificate of need (CON) requirements, including hospitals, clinics, ambulatory surgical centers, radiation therapy, chemotherapy, and oncology research facilities

Covers medical technology such as linear accelerators, proton therapy systems, and PET scanners used primarily for cancer detection, diagnosis, or treatment

Requires exempt facilities to comply with federal and state oncology regulations, submit patient volume and treatment data to verify compliance, and provide annual reports

Exemption applies regardless of ownership structure, hospital affiliation, or location within Georgia

Exemption does not apply to facilities within 35 miles of an existing nonprofit sole community hospital (per 42 C.F.R. 412.92) that already offers chemotherapy or radiation therapy
