GA SB39

Prohibits the Georgia state health benefit plan from covering gender-affirming care, including hormone therapy and sex reassignment surgeries, effective January 1, 2026

Bans state funds from being used for any health benefits coverage that includes gender-affirming care, and prohibits state-owned healthcare facilities and state-employed providers from providing such care

Extends the prohibition to recipients of Medicaid and other public medical assistance programs administered by the state

Includes limited exceptions for medically necessary treatments unrelated to gender dysphoria, individuals born with disorders of sex development or ambiguous genitalia, and those with partial androgen insensitivity syndrome

Allows individuals, private entities, and local governments to purchase separate gender-affirming care coverage using non-state funds
