Establishes joint legal and physical custody as the default custody arrangement in Georgia, replacing the current system where joint custody is merely one alternative to consider

Creates a rebuttable presumption that joint legal and physical custody with equally shared parenting time is in the best interests of the child

Presumption can be overcome by a preponderance of the evidence showing an alternative arrangement better serves the child's interests

Removes existing language stating there shall be no presumption in favor of any particular custody form or either parent

Courts retain authority to order sole custody, joint custody, joint legal custody, or joint physical custody at temporary or permanent hearings when deviations from equal parenting time are warranted
