Georgia citizens would have the right to use nonnavigable streams for passage only, using shallow draft motorized recreational vessels, canoes, kayaks, rafts, or tubes when the stream has sufficient natural depth to support the watercraft.

Landowners retain exclusive possession of nonnavigable streams on their property, similar to other parts of their land.

The General Assembly declares that citizens have an inherent common law right to use nonnavigable streams solely for the purpose of passage.

Entry upon privately owned land adjacent to nonnavigable streams is explicitly prohibited under this act.

Amends Code Section 44-8-3 of Title 44, Chapter 8 of the Official Code of Georgia Annotated relating to water rights.
