Family members or law enforcement officers may petition superior courts for risk protection orders to temporarily remove firearms, ammunition, and weapons carry licenses from individuals who pose a significant danger of causing personal injury to themselves or others

Courts must hold hearings within 14 days of petition filing; orders require clear and convincing evidence and may last up to 12 months, with possible extensions

Temporary ex parte orders may be issued without prior notice to the respondent if there is reasonable cause to believe imminent danger exists, with a hearing required within 2 business days

Respondents must immediately surrender all firearms, ammunition, and weapons carry licenses to law enforcement upon service of an order; violations constitute a high and aggravated misdemeanor

Orders are entered into the Georgia Crime Information Center and National Crime Information Center databases; the Administrative Office of the Courts must develop standardized forms and instructional materials for use after January 1, 2025
