Transfers jurisdiction of small boat harbors, boating programs, ocean recreation, and coastal areas programs from the Department of Land and Natural Resources (DLNR) back to the Department of Transportation (DOT), effective July 1, 2011.

Requires the Director of Transportation to make a public interest finding and administer the negotiation process when leasing boating facility fast lands by direct negotiation.

Transfers all related rights, powers, functions, duties, employees, appropriations, records, equipment, and contracts from DLNR to DOT; protects employee tenure, seniority, benefits, and prevents loss of salary or civil service status.

Establishes DOT jurisdiction over ocean waters, navigable streams, and all harbors and waterfront improvements, with DOT responsible for boating safety, conservation, search and rescue, vessel registration, and enforcement of boating regulations.

Appropriates funds for fiscal years 2009-2010 and 2010-2011 to hire staff to plan and prepare for the program transfer.
