HI HB1394

Establishes a Department of Land and Natural Resources (DLNR) "aquarium collecting white list" of approved aquatic species for each county that can be legally collected or sold for aquarium purposes.

Only species meeting survival criteria (can survive capture, transport, and captivity for at least 180 days) and showing stable or increasing population trends based on official studies may appear on the white list.

Prohibits collection of endemic Hawaiian species and limits annual collection amounts to not exceed the average from 2005-2007 based on department reports.

Imposes fines of $1,000 per specimen collected or sold for unlisted species, with escalating criminal penalties: first violation up to $1,000 fine or 30 days imprisonment; second violation up to $2,000 or 60 days; third or subsequent violation up to $3,000 or 90 days.

Takes effect June 1, 2009.
