HB1913 Summary

• Amends Hawaii Revised Statutes Section 383-7.6 to clarify that individuals are not disqualified from unemployment benefits if they separate from employment due to domestic or sexual violence that jeopardizes their safety or their immediate family's safety.

• Establishes acceptable documentation for verifying domestic or sexual violence claims, including notarized statements, statements from victim services organizations or medical professionals, or police/court records.

• Requires strict confidentiality of all information related to domestic or sexual violence submitted to the department, with disclosure prohibited except when requested by the employee, ordered by court, or required by law.

• Provides that victims of domestic or sexual violence have good cause for refusing otherwise suitable work if they reasonably believe the employment would subject them or others to unreasonable risk of violence.

• Effective July 1, 2010.
