H.B. 1930 Summary

• Allows probationers without felony drug convictions who have a debilitating medical condition to request court confirmation to use medical marijuana and to request modification of probation conditions to authorize such use.

• Permits parolees without felony drug convictions who are eligible qualifying patients to request modification of parole conditions to allow medical marijuana use, with written documentation of requests granted or denied.

• Provides parolees the right to pursue administrative appeal of denied medical marijuana requests, with written decision and reasons required.

• Amends probation and parole violation provisions to exclude medically authorized marijuana use from substance abuse treatment program requirements, except as provided in the new medical marijuana sections.

• Effective date: December 21, 2050.
