Changes the wireless enhanced 911 surcharge from mandatory to permissible, allowing it to be imposed "may" rather than "shall" be imposed on commercial mobile radio service connections.

Adds definitions to section 138-3 specifying that fund expenditures are limited to deployment of phase I and phase II wireless enhanced 911 service and administrative expenses, excluding ongoing operational costs.

Requires the wireless enhanced 911 board to submit annual reports to the legislature no later than twenty days before each regular session beginning in 2010, including cost studies that specify the surcharge level needed to fund board expenses and planned expenditures.

Mandates an audit by the state auditor beginning in 2014 and every five years thereafter to review whether fund expenditures should require legislative appropriation and to recommend oversight improvements for board accountability.

Removes the January 1, 2005 date restriction for public safety answering points to seek reimbursement from the fund and clarifies that reimbursements may supplement but not replace regularly appropriated county funds for equipment and maintenance costs.
