Requires all businesses in Hawaii to charge customers a 10-cent offset fee for each disposable checkout bag beginning January 1, 2011.

Extends the 10-cent offset fee to disposable newspaper bags and laundry or dry cleaning bags beginning December 21, 2012.

Exempts certain bags from the fee, including bulk item bags, bags for frozen foods or flowers, prescription medication bags, and pre-packaged garbage or pet waste bags.

Requires businesses to retain offset fees and use them solely for consumer education on recycling and reuse.

Prohibits businesses from reimbursing customers for any portion of the offset fee, with violations subject to fines of not less than $1,000 per violation.
