HB2167 Summary

• Creates a new chapter in Hawaii Revised Statutes establishing licensing requirements for archaeologists in the state.

• Establishes a 10-member Board of Archaeologists consisting of the state historic preservation officer, a representative from the Historic Hawaii Foundation, five licensed archaeologists with at least three years of field experience, and three public members.

• Requires a license for any person conducting archaeological fieldwork, altering or removing artifacts, or operating submersible vehicles or diving equipment within 500 feet of marine archaeological sites in state waters.

• Grants the Board authority to develop licensing standards, set fees, issue and revoke licenses, adopt rules, and establish penalties for violations through chapter 91 rulemaking procedures.

• Exempts normal agricultural work, routine property maintenance, and activities allowed by administrative rule from licensing requirements.
