HB 2644 Summary

• Establishes a solid waste management surcharge of 35 cents per ton of solid waste disposed at permitted or unpermitted facilities within the state, including landfills, incinerators, and waste-to-energy facilities.

• Extends surcharge applicability to solid waste collected at in-state reduction facilities for transport to out-of-state landfills, incinerators, or waste-to-energy facilities.

• Requires the person or entity conducting disposal or responsible for preparing waste for out-of-state transfer to pay the surcharge.

• Mandates facility owners or operators to submit quarterly surcharge estimates prior to each quarter and transfer collected moneys to the department within 30 days of quarter-end.

• Takes effect July 1, 2010.
